1. Agreement to These Terms

By accessing or using My MASH Card (the "Service") at mymashcard.com, you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

These Terms are a contract between you and Chell Brown LLC d/b/a Marketing and Sales Help ("MASH," "we," "us," or "our").

2. About the Service

My MASH Card is a digital business card and lead capture platform. You can create one or more digital business cards, share them via QR code or link, capture contact information from people who scan or visit your card, organize and follow up with those contacts, and connect to third-party tools like CRMs, Google Sheets, and email platforms.

The Service includes both free and paid (Pro) features. Some features are reserved for Pro subscribers.

3. Eligibility

You must be at least 18 years old to create an account. By signing up, you confirm you meet this age requirement and have the legal capacity to enter into this agreement.

The Service is not intended for children under 16, and we do not knowingly accept registrations from anyone under 16.

If you're using the Service on behalf of a business or organization, you confirm that you have authority to bind that entity to these Terms.

4. Your Account

You're responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, behave abusively, or pose security risks.

5. Subscription Plans and Billing

We offer a free tier with limited features and a Pro subscription that unlocks the full feature set, including unlimited cards, multiple integrations, automation, advanced analytics, and more.

Pro plans are billed monthly or annually through Stripe. Annual plans are typically discounted. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.

You can manage your subscription, view invoices, and update payment methods through the Stripe Customer Portal, accessible from Settings → Billing.

We do not store credit card numbers, CVV codes, or bank account details. All payment processing is handled by Stripe in accordance with their security and compliance standards.

Pricing is shown on our pricing page and may change. We'll give you at least 30 days' notice before any price increase affects your subscription.

6. Free Tier

The free tier lets you create one digital business card and capture leads with basic features. Some functionality (multiple cards, CRM integrations, automation, advanced analytics, marketing tools) is reserved for Pro subscribers.

Free accounts may be subject to usage limits, including a cap on the number of leads captured. We'll notify you in the Service if you're approaching a limit.

7. Refunds and Cancellation

You can cancel your Pro subscription at any time from Settings → Billing. Cancellation stops future renewals. Your subscription remains active until the end of your current billing period.

Refund policy: If you're not satisfied with your Pro subscription, email us at support@marketingandsaleshelp.com within 14 days of your first paid charge and we'll refund you in full, no questions asked. After 14 days, refunds are at our discretion.

Annual subscriptions are non-refundable after the 14-day window, but you can cancel anytime to stop the next year's renewal.

8. Your Card and Content

You retain ownership of all content you add to your digital business card, including your name, photo, bio, and any custom links or media you upload.

By using the Service, you grant us a limited license to host, display, and process your content as needed to operate the Service (for example, displaying your card to people who visit its URL).

You're responsible for ensuring your card content:

  • Is accurate and not misleading
  • Doesn't violate any law or third-party rights (including intellectual property, privacy, or publicity rights)
  • Doesn't contain hateful, harassing, illegal, or otherwise harmful material

We reserve the right to remove content that violates these standards or to suspend cards that do.

9. Lead Data and Your Responsibilities

When you use My MASH Card to capture contact information from other people (your "leads"), you are responsible for:

  • Obtaining the lead's consent to collect their information where required by applicable law (such as GDPR, CCPA, CASL, or similar regulations)
  • Handling lead data lawfully and in accordance with applicable privacy laws
  • Honoring requests from leads to access, correct, or delete their data
  • Ensuring that any follow-up communications you send to leads (manual or automated) comply with applicable anti-spam laws (CAN-SPAM, CASL, GDPR ePrivacy, etc.)

You are the data controller of lead data captured through your cards. MASH acts as a data processor on your behalf.

If a lead contacts MASH directly to request access, correction, or deletion of their data, we'll work with you to fulfill the request as required by law. You agree to cooperate with us in responding to such requests within applicable legal timeframes.

10. Third-Party Integrations

The Service supports integrations with third-party platforms including (but not limited to) Google Sheets, Google Drive, LinkedIn, CRM platforms, custom webhooks, Stripe, and Encharge.

When you enable an integration:

  • You authorize MASH to send data between your account and the third-party platform as described in the integration's configuration
  • You're subject to the third party's own terms of service and privacy policy
  • You're responsible for maintaining valid credentials and permissions with the third party

We're not responsible for the availability, behavior, accuracy, or security of third-party services. If a third party changes their API, pricing, or terms in ways that affect our integration, we'll do our best to maintain compatibility but make no guarantees.

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited marketing, or harassing communications to leads or other users
  • Capture or store contact information without the subject's knowledge or consent where required by law
  • Use the Service to facilitate fraud, scams, or deceptive practices
  • Attempt to gain unauthorized access to other accounts, our systems, or the systems of integrated third parties
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Scrape, harvest, or systematically collect data from the Service (other than your own data)
  • Use the Service to host or distribute malware, viruses, or other malicious code
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Resell, sublicense, or commercially exploit the Service without our written permission
  • Use automated tools or bots to interact with the Service in ways not explicitly permitted

We reserve the right to investigate suspected violations and take appropriate action, including suspending or terminating accounts.

12. Intellectual Property

The Service, including its software, design, branding, content (other than your card content and your captured lead data), and all related intellectual property, is owned by Chell Brown LLC or our licensors. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our written permission.

If you believe content on the Service infringes your copyright, please contact us at support@marketingandsaleshelp.com with sufficient information to identify the work and the allegedly infringing content.

13. Modifications to the Service

We're constantly improving My MASH Card. We may add, change, or remove features at any time. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

If we make material changes that significantly reduce the functionality you're paying for, we'll give you reasonable notice and the option to cancel for a prorated refund.

14. Termination

You can stop using the Service and delete your account at any time through Settings → Danger Zone.

We may suspend or terminate your access to the Service at any time, with or without cause, including if:

  • You violate these Terms
  • You fail to pay subscription fees
  • Your use of the Service creates legal, security, or operational risks
  • We discontinue the Service entirely (with reasonable advance notice)

Upon termination:

  • Your access to the Service ends
  • Your data is deleted according to our Privacy Policy
  • You remain liable for any outstanding fees
  • Provisions that by their nature should survive (such as intellectual property, disclaimers, liability limits, and indemnification) continue to apply

15. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't guarantee that the Service will be uninterrupted, error-free, secure, or meet your specific needs.

We make no representations about the accuracy, reliability, completeness, or timeliness of any content, including content generated by third-party integrations or AI features (such as email drafts or the diagnostic agent).

You use the Service at your own risk.

16. Limitation of Liability

To the fullest extent permitted by law, MASH and its officers, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages (including lost profits, lost data, lost goodwill, or business interruption) arising from your use of or inability to use the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) $100 USD.

Some jurisdictions don't allow certain limitations of liability, so portions of this section may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless MASH and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party right (including data privacy laws related to leads you capture)
  • Any content you submit to the Service

18. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top and, for material changes, notify you by email or through a prominent notice in the Service before the changes take effect.

Continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree with the changes, you can cancel and stop using the Service.

19. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of laws principles.

Any disputes arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.

Before filing any formal claim, you agree to first contact us at support@marketingandsaleshelp.com to attempt to resolve the dispute informally. We'll respond within 30 days.

20. Miscellaneous

Entire agreement. These Terms, along with our Privacy Policy, constitute the entire agreement between you and MASH regarding the Service.

Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.

No agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and MASH.
